What is RERA Registration

RERA Registration refers to the mandatory registration under the Real Estate (Regulation and Development) Act, 2016, which was introduced by the Government of India to regulate the real estate sector and promote transparency, accountability, and fair practices. Under this Act: Builders/Promoters must register their real estate projects with the respective State RERA authority before advertising, marketing, selling, or offering any units to buyers. Real Estate Agents/Brokers must also obtain RERA registration to legally facilitate property sales. The main objectives of RERA registration are to: Protect homebuyers’ interests. Ensure timely delivery of projects. Reduce fraud and malpractice in the real estate sector. Establish a uniform legal framework across states.

Who Requires RERA Registration

RERA Registration is mandatory for the following categories:

  1. Real Estate Promoters/Builders

    • Any promoter or builder who is developing a real estate project where the land area exceeds 500 sq. meters or the number of apartments exceeds 8 units (including all phases) must register the project with the respective State RERA authority before advertising or selling.

  2. Real Estate Agents/Brokers

    • Any agent, broker, or intermediary involved in facilitating the sale or purchase of property in a RERA-registered project must also obtain RERA registration. This ensures they can legally operate and build credibility with buyers and developers.

  3. Joint Development Projects

    • If a landowner and developer enter into a joint development agreement, the project also requires RERA registration.

  4. Ongoing Projects (Not Completed Before May 2017)

    • Projects that were launched before the RERA Act came into effect but were not completed must be registered to comply with the law.

Types of RERA Registration

RERA Registration is broadly divided into two main categories based on the role in the real estate sector:

  1. RERA Registration for Promoters/Builders

    • Mandatory for all developers and promoters who are launching new residential or commercial projects that exceed 500 sq. meters of land area or have more than 8 units (including all phases).

  2. RERA Registration for Real Estate Agents

Documents Required for RERA Registration

To obtain a RERA Registration, applicants must provide the following documents:

  • For Promoters/Builders

    Promoters or builders who want to register their real estate project under RERA must provide the following documents:

    • PAN Card of the builder/promoter

    • Aadhaar Card of the promoter/partners/directors

    • Proof of business registration (Partnership deed/Company Incorporation Certificate, etc.)

    • Audited balance sheet of the last 3 years & Income Tax Returns

    • Details of the project (location, site plan, layout plan, floor plan, and project schedule)

    • Title deed and legal ownership documents of the land

    • Encumbrance certificate (if applicable)

    • Details of approvals and commencement certificates from the competent authority

    • Parking details (covered/open)

    • Details of contractors, architects, engineers, and structural engineers involved in the project

    • Project bank account details as per RERA norms

    . For Real Estate Agents/Brokers

    Real estate agents or brokers seeking RERA registration need to submit the following documents:

    • PAN Card of the applicant (individual/company/firm)

    • Aadhaar Card of the applicant/partners/directors

    • Proof of business address (ownership document or rent agreement)

    • Company/firm registration certificate (if applicable)

    • Memorandum of Association (MOA) & Articles of Association (AOA) or Partnership Deed (as applicable)

    • Passport-size photographs of the applicant/partners/directors

    • Income Tax Returns of the last 3 years (if applicable)

    • Contact details (email ID, phone number)

    • Business letterhead & rubber stamp specimen

RERA Registration Process

The process of obtaining RERA Registration differs slightly for Promoters/Builders and Real Estate Agents, but the overall steps are similar.

1. For Promoters/Builders

  1. Create an Account – Register on the respective State RERA portal.

  2. Fill the Application Form – Provide project details including land area, project layout, approvals, and completion schedule.

  3. Upload Documents – Submit ownership documents, approvals, PAN, Aadhaar, financial details, and other required papers.

  4. Project Bank Account – Provide details of a separate bank account where 70% of project funds will be deposited as per RERA rules.

  5. Pay Fees – Make the prescribed payment online through the RERA portal.

  6. Verification by Authority – The State RERA authority will scrutinize the documents and application.

  3. Upload Documents – PAN, Aadhaar, business address proof, ITRs, and other required documents.

  4. Pay Registration Fees – Submit the applicable fee online.

  5. Verification – The RERA authority will check the authenticity of the documents.

  6. Grant of Registration – A RERA registration certificate and unique ID number is issued, which must be quoted in every property transaction.

RERA Registration Fee Structure

The fee for RERA registration varies depending on whether you are a Promoter/Builder or a Real Estate Agent. It is also subject to change by the respective State RERA Authority, but the general structure is as follows:

1. For Promoters/Builders

  • Residential Projects – Fees are usually calculated on the basis of project size (per sq. meter).

  • Commercial Projects – Generally higher than residential projects; charged per sq. meter of development area.

  • Mixed Development Projects – Charged as per the type and size of the project.

(Example: In many states, fees range between ₹5 to ₹10 per sq. meter for residential and ₹10 to ₹25 per sq. meter for commercial projects, subject to a minimum and maximum cap.)

2. For Real Estate Agents/Brokers

  • Individual Agents – Around ₹10,000 to ₹25,000 (varies by state).
